James Stuckey | Thoughts on Strategic Litigation

James Stuckey, former President of the New York City Public Development Corp., explains that once a real estate development idea is brought to the table, there are other obstacles to overcome.

According to James Stuckey, while the first step in any real estate project is to shape the idea, the next step is to develop a strategy to respond to those individuals who may bring lawsuits, why, and what can be done to ensure they are not successful. In the real estate realm, says James Stuckey, winning the lawsuits are the penultimate land use approvals.

James Stuckey points out that few members of the public, and an even smaller number of “decision-makers,” understand what the information in a Final Environmental Impact Statement (FEIS) tells them; and, those that do are given unreasonably short periods of time to analyze and respond to the data. According to James Stuckey, Environment Impact Statements and the EIS process have really become a tool to litigate, delay or stop a development. Unfortunately, laments James Stuckey, almost no one pays attention to the environmental impacts that are disclosed; and, in some instances, because some impacts can’t be mitigated, all that’s required is disclosure.  This is true for all land use approvals, as virtually any decision made by a public official or public body is subject to challenge in court, notes James Stuckey.

Other factors that may impact the pre-development phase, says James Stuckey, are blogs, the Internet, and instant access to information (including false information that project opponents or competitors can “create” on the web), and these have changed litigation strategies. There have also been instances where regions, states and municipalities have used litigation to block projects, steal or retain corporate tenants, and leverage infrastructure improvements, maintains James Stuckey.

During his three-decade long career, James Stuckey has seen countless lawsuits. For instance, there were dozens of suits initiated over the course of twenty years to litigate against and stop the Times Square Redevelopment. Lawsuits can focus on issues such as land use claims and environmental issues to eminent domain and first amendment rights, according to James Stuckey.

Nearly any person or group of people can bring a lawsuit to try to block a specific development, notes James Stuckey. Before Hamilton Plaza, a project in the Gowanus section of Brooklyn, a group of local merchants brought a federal suit that tried to block the addition of a large supermarket to the neighborhood.

A developer must wear many hats before he can get down to business, says James Stuckey. He must endeavor to foresee all issues that may arise, determine the best course of action to circumvent these issues, and make a convincing case as to why the proposed development should be allowed to proceed, concludes James Stuckey.

James Stuckey is not only a hands-on real estate developer; he is also an educator who has served as the Dean of the New York University Schack Institute of Real Estate.

Fasculo: Whether a new home or a kitchen or bathroom remodeling project, your choice for counter tops and wash basins is important to both the style and function.  With a natural appearance of stone becoming increasing popular, more counter tops are taking on the granite look.  With the beauty of granite come certain limitations.  Designers and manufactures have been developing new materials that capture that beauty of polished stone without the downside.  I’m here with Vince Albachiaro from Designs and Solid Surface, a Florida authorized pre-owned fabricator.  And, Vince, we need not look far around this kitchen to see what jumps out at us.

Albachiaro: We have a beautiful countertop here, don’t we?

Fasculo: We really, really do.  And I think most people who are watching at home would think that this is some sort of stone or quartz, but in fact it’s not!

Albachiaro: No, this is premier solid surfacing from Kanwa Surfaces.

Fasculo: Very nice.

Albachiaro: Yes, it’s a solid surface—the premier solid surface.  So it’s totally seamless, it is environmentally friendly, it’s durable, it’s stain, chemical-resistant, and resistant to heat also.

Fasculo: Wow!  You know, I find it unique that you said it’s environmentally friendly.  How do you make a countertop environmentally friendly?

Albachiaro: Well, we’re very concerned about the environment.  And that’s why we use 22% recycled materials in the beautiful countertop that we have here.

Fasculo: That is something we all need to concern ourselves with.

Albachiaro: Absolutely.

Fasculo: Also, I mean, when I look at this I think what it might cost for this to be a stone.  In fact, it’s seamless; it would be ten times what you would pay for this.

Albachiaro: Yes.  Solid surfacing allows you to have a seamless appearance in a continuous running surface, where you can have coal back-splashes, intricate sinks, and you can use it in many different areas.  Let’s talk about some of the different colors and applications that we have.  It comes in twelve beautiful colors.  This one, Tumo, is our color that we’re using here in the kitchen.  And again, because it’s a solid surface, it’s easy to clean and easy to maintain.

Fasculo (Designing Spaces): You know what?  I love some of the names of these.  I see Rhythmic Shine, and Orange Moon, Leche, Tiara, all across the board.  So literally, something for every kitchen!

Albachiaro: Absolutely.  Also, it’s great for use in bathrooms.  It has an NSF 51 Certification for food service applications.

Designing Spaces: And I also understand it’s very easy to clean.  Can you go ahead and give me a demonstration?

Albachiaro: It is really simple.  It’s simple soap and water—just a wiping on the surface and a wiping off.  Because it’s nonporous, nothing penetrates it.  Where, with natural stones and granites and quartzes, any of those products—they can absorb water.  And that’s where mold and mildew grows.  And that’s what you can’t get with the solid surfaces.

Designing Spaces: Especially great for us who have little kids.

Albachiaro: Absolutely.

Designing Spaces: Now, I also understand that there is a quality about Breon that most people probably wouldn’t understand.  Could you describe that to me?

Albachiaro: Well, they say this material actually admits far more infrared rays, which is supposed to have a soothing and calming effect on the people in the kitchen.

Designing Spaces: This is a good thing, especially around Thanksgiving so I can cook that turkey and be calm throughout the entire ordeal.

Albachiaro: That’s what they say. I prefer a glass of wine.  But that is what they say.

Designing Spaces: Well, that sounds great!  I’m calm already. Vince, thank you so much for inviting me into this lovely kitchen.  This Henwa Surfaces Breon line is fantastic.

James P. Stuckey says Atlantic Yards is Long Overdue

James P. Stuckey, one of the original initiators of the Atlantic Yards project, says this massive development is bringing more than just jobs to the area; it will give a fresh face to New York City. James P. Stuckey says that the project currently employs over 650 workers. More than two thirds of these are New York City residents, adds James P. Stuckey, with nearly 200 coming from the surrounding community of Brooklyn.

According to James P. Stuckey, the project is providing far more than just temporary employment. The $4.9 billion development will include a combination of retail, office, and residential space along with several community facilities, reports James P. Stuckey. When all is said and done, it is estimated that new job creation will be in the thousands, points out James P. Stuckey.

Once completed, Atlantic Yards will be the epicenter of sports and entertainment, according to James P. Stuckey. He says that the development’s 850,000 square foot arena, the Barclays Center, will be the new home of the professional basketball team currently known as the New Jersey Nets. In addition to sports, James P. Stuckey also reports that the arena will host a number of events including concerts and family entertainment.

As the project progresses, James P. Stuckey is confident that the Atlantic Yards development will bring with it a sense of community pride of which the city can be proud. The area, he says, deserves revitalization and James P. Stuckey believes that project will benefit Brooklyn, as well as all of New York City, for years to come.

Interview with Joe Aldeguer at the Los Angeles Premiere of “Nobody, Nobody But Juan”

Interviewer: Hey what’s up guys? In case you guys didn’t know, this film has people working from the back, and part of the cast, all in one. Great movie. I actually have one of the co-executive producers with Nobody, Nobody But Juan. I have to ask, how is it working with the comedy king?

Joe Aldeguer: You know, initially you’re definitely intimidated. It’s Dolphy—the king of comedy.  From the moment he says “hello” to you—he’s Dolphy. He treats you just like you’re one of his family. He’s absolutely unbelievably humble. That was really a surreal event. But immediately the surrealness just goes away.

Interviewer: Cool. You know what? I forgot to ask a lot of the people that I interviewed—. Give me a few names of the people in the cast.

Joe Aldeguer: Well, there is of course Eric Quizon who plays his son and my brother in the movie. He’s also the director of the film. There’s G. Toengi. There’s Pokwang. There’s Willie Revillame. He does a special appearance and a guest on there. There’s Heart Evangelista. There’s of course Eddie Garcia, Gloria Romero. The cast is a long cast.

Interviewer: It sounds like a star-studded cast.

Joe Aldeguer: Yeah. There’s also Epi Quizon, and also Vandolph.

Interviewer: So you have, like, the Quizon is president of the movie. I have to ask, what is the fondest moment you have with making the movie?

Joe Aldeguer: Well, the fondness is obviously, you know, coming from the United States—this was my first project in the Philippines. The vastness of the movie. There’s a lot of moving parts in the film—a lot of film crew, there’s truck loads, and the entourage that comes with the Dolphy name.

Interviewer: Would you say it’s like culture shock of having films independently made here to films being made over there?

Joe Aldeguer:Well, yes, because there are so many more people involved there because, of course, you know, it’s easier to make a movie in the Philippines but it’s more fun.  Being Filipino-American you feel home right away. It was my first time in the Philippines as an adult. But as soon as you walked off the plane you feel like you were home. You know what I’m talking about?

Interviewer: Cool. I know with the scripts and whatnot is it exactly what you guys envisioned it out to be?

Joe Aldeguer: Reading the script it comes out so differently than what you actually see in the film. There’s a lot that goes into the film. The scenes are definitely a lot more vivid than real life, of course. And also the script changes a lot. Of course working with Dolphy who is the king of impromptu –he absolutely ad libs everything. But he ad libs it to make more of it, to involve more people, to have more fun with the film.

Interviewer: I hear he makes everybody so comfortable on the set trying to work with him. So everybody is not nervous around him.

Joe Aldeguer: Not at all. Again, it’s a big family affair. Really the whole cast becomes Dolphy’s family—the whole thing becomes like a big extended Dolphy family.

Interviewer: It sounds really great. You guys make sure to check out Nobody, Nobody But Juan. Let’s go ahead and invite our viewers out there.

Joe Aldeguer: Well, real quickly. This is going to be the first Filipino film that is going to hit AMC Theaters or mainstream theaters in the United States. The first film. And who better to represent our culture or our films than Dolphy, Dolphy himself. Sixty-five years is the anniversary this year. In the L.A. area it’s going to be in Covina and also Long Beach. AMC. Alamo-Based Timothy Powers Notes Increased Demand for Rental Properties

With the housing market in such turmoil, Alamo, California’s Timothy Powers points out that one area is fluctuating: rental properties. Banks have tightened down loan procedures to the point that even consumers with good credit are having a hard time purchasing a house, Timothy Powers of Alamo points out.

Luckily for Americans, rental properties are in available, giving prospective renters a choice beyond the traditional apartment or condo rental, Alamo’s Timothy Powers says. Timothy Powers of Alamo points out that desperate homeowners, who may be unable to pay a mortgage while waiting months, possibly even years, are putting properties up for rent. According to Timothy Powers of Alamo, this creates plenty of rental opportunities for those who can’t qualify for a home or would actually prefer to rent. This group of homeowners may be risky renting from because the property may go into foreclosure and you might be expected to move earlier then anticipated sites, Tim Powers of Alamo.

Experts are saying the home market could take years to rebound, Timothy Powers of Alamo points out, meaning homeowners could be stuck in homes for years. Many of these homeowners are now “upside down” in their mortgages, Alamo’s Timothy Powers points out, meaning they owe more than they could get if they sold. Homeowners are advised to wait it out, according to Timothy Powers of Alamo, but that isn’t always an option, as forced relocation and inability to afford monthly payments force homeowners to find a way out of a mortgage.

Unfortunately, the economy has forced many homeowners to fall behind on mortgage payments, Timothy Powers of Alamo says, leading them to eventually face foreclosure. As owner of East Bay Foreclosure Support, Alamo’s Timothy Powers assists homeowners who have fallen on hard times. These homeowners often have no choice but to turn to renting, Alamo-based Timothy Powers says, and with the damage foreclosure does to credit, landlords are hesitant to rent. In addition, Timothy Powers of Alamo points out that rent costs are on the rise in general, causing cash-poor consumers to desperately seek out lower-rent properties.

Alamo’s Timothy Powers does note, however, that the market means good news for investors. The time has never been better to buy into rental property, Timothy Powers of Alamo observes. Since housing prices are lower than they have been in years and rent prices are on the rise, a landlord stands to make money right now. And, better yet, eventually property values will begin climbing again, making that investment pay off  over the years.

Gregory Leb Talks About the Beauty of Ponte Vedra

Located just eighteen miles from downtown Jacksonville, Florida, Ponte Vedra Beach is miles of beautiful, sandy beach among the much-loved Jacksonville beaches. For Gregory Leb, Ponte Vedra provides a great escape from the hustle and bustle of downtown Jacksonville, where he has worked as national account manager for Sissine’s Office Systems for the past five years.

Known as the home of the ATP Tour, PGA Tour, and The Players Championship, Ponte Vedra Beach is reportedly the home of several professional golfers, including Bob Duval, David Duval, Fred Funk, and Jim Furyk, Gregory Leb says. Gregory Leb remembers when the city offered half of the property to the commissioner of the PGA Tour at the time for only a dollar. Gregory Leb says the one-dollar deal brought all of these golf groups to Ponte Vedra, which in turn increased national interest in the touristy area.

Other famous Ponte Vedra residents, according to Gregory Leb, are Kim Alexis, football player Tony Boselli, and Theodore Roosevelt, Jr. Gregory Leb points out that the area is home to two highly rated resorts—Ponte Vedra Inn and Club and the Lodge and Club. Most of the beaches in Ponte Vedra have limited public access, Gregory Leb relates, allowing Ponte Vedra residents to enjoy privacy and exclusivity.

Gregory Leb’s home of Ponte Vedra has a population listed as 35,400 in 2005, the same year Ponte Vedra was a finalist for CNN’s and Money Magazine’s list of the best places to live. Gregory Leb says it was one of only four areas in the state of Florida to make the finalist list.
